Welcome to LiveGen. LiveGen ("LiveGen," "we," "us," or "our") is operated by comiaos, LLC, with a registered address at 131 Continental Dr, Suite 305, Newark, DE 19713, US.
These Terms of Service ("Terms") are a binding legal contract between you and LiveGen governing your access to and use of the Services — the LiveGen website(s) at livegen.ai, our apps, and related products and features. LiveGen is a browser-based, zero-install web application for real-time interactive AI video: you open your camera (or upload a video or image), and the Services transform it live using the six creative modes described in Section 4.
Please read these Terms carefully. By creating an Account, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Documents incorporated by reference. The following are incorporated into and form part of these Terms:
Governing law and disputes. These Terms are governed by the laws of the State of Delaware, USA. How disputes are handled — including your rights as a consumer — is described in Section 14.
We may update these Terms from time to time — for example, to reflect new features, changes to the six modes, legal or regulatory requirements, or changes to how the Services work.
We encourage you to review these Terms periodically. The "Last updated" date at the top shows when they were last revised.
Age requirements. You must be at least 13 years old to use the Services. If you are in the EEA, the UK, or Switzerland, you must be at least 16 years old (or older where your local law sets a higher age of digital consent). If you are under the age of majority where you live, you may only use the Services with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. The Services are not intended for children below these thresholds, as further described in our Privacy Policy.
Accurate information. When you create an Account (a registered LiveGen user account), you agree to provide accurate, current, and complete information and to keep it up to date.
Your responsibility for your Account. You are responsible for:
You may sign in using a third-party single sign-on (SSO) provider where available; your use of that provider is subject to its own terms. You may not share your Account, sell or transfer it, or let others use it. One person or legal entity may not maintain more than one free Account to obtain additional free credits or to evade limits or enforcement.
License to use the Services. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal or internal use (and, if you have a paid plan that permits it, for the commercial use described for that plan).
The six modes. The Services let you transform live or uploaded video and images in real time using the following creative modes:
How real-time generation works (important). LiveGen is built on the Xmax X2.0 model provided by Xmax, an independent third party. To generate your Output in real time, your Inputs — including your live camera feed — are streamed over WebRTC to Xmax, processed to produce the transformed result, and rendered back into your browser. This means your live camera video, including your face and likeness (which is biometric/facial data), is transmitted off your device to be processed. Your live feed does not "stay on your device." As designed, the raw stream is not retained beyond what is needed to produce the Output; only Creations you choose to save, export, publish, or share are stored. Reference images and other files you upload are sent to cloud object storage (Cloudflare) and returned as a URL used as the reference for generation. See our Privacy Policy for full details on this data flow, retention, and the legal bases for processing biometric data (which relies on your consent).
Camera, microphone, and device permissions. The Services require your permission to access your camera (and, for some features, your microphone) through your browser. You can grant or revoke these permissions at any time in your browser or device settings, but revoking them will prevent real-time features from working. By enabling your camera and using a mode that processes it, you consent to your live feed being streamed to Xmax and processed as described above and in the Privacy Policy.
You must have the rights and consents for what you use. You are solely responsible for the Inputs you submit. You represent and warrant that you have all rights, licenses, and consents necessary for every face, person, voice, likeness, image, video, character, logo, artwork, or other content you use with the Services — including the explicit consent of any real, identifiable person whose face or likeness you swap, animate, restyle, or otherwise depict. This requirement is central to a face-swap and likeness product and is detailed in Section 5.
Because LiveGen can transform faces, bodies, and likenesses in real time, responsible use is essential. This section is a core part of these Terms. You agree not to use the Services to create, upload, generate, save, publish, or share any Inputs, Outputs, or Creations that:
Likeness, consent, and deepfakes
Illegal, harmful, and infringing content
Platform integrity
Your representations. By submitting Inputs and creating Outputs, you represent and warrant that you have all necessary rights and consents for every person depicted and all content used, and that your use complies with these Terms and applicable law, including any law requiring you to label or disclose AI-generated or synthetic media.
Moderation and enforcement. We may use automated and human review to detect violations. We may remove, restrict, refuse to generate, or disable access to any content, and may suspend or terminate Accounts, as described in Section 10. We are not obligated to monitor all content, but we may do so.
Definitions. For clarity, in these Terms:
You keep ownership of your User Content. As between you and LiveGen, you retain all ownership rights you hold in your User Content. We do not claim ownership of it.
License you grant to us. To operate and provide the Services, you grant LiveGen a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit (including streaming your Inputs over WebRTC to Xmax and uploading reference files to Cloudflare), modify (for technical purposes such as formatting and resizing), and display your User Content and Outputs — solely to provide, secure, and improve the Services and to enforce these Terms. For Creations you choose to make public (for example, on public creation pages or a community gallery), you additionally grant us a license to host, reproduce, display, distribute, and promote those public Creations in connection with operating and marketing the Services. You can remove public Creations, and we will stop displaying them going forward, though cached or previously shared copies may persist for a limited time or in the hands of others who accessed them.
We do not train our models on your content. We do not use your User Content, Inputs, Outputs, or Creations to train our own AI models. We may use aggregated and de-identified data that does not identify you or any individual to operate, secure, analyze, and improve the Services. Xmax processes your streamed Inputs as an independent provider / sub-processor under its own terms and privacy practices, and we require data-protection commitments consistent with applicable law. See the Privacy Policy for details.
Your Outputs. Subject to these Terms, applicable law, and any third-party rights, you may use the Outputs and Creations you generate, including (where your plan permits) for commercial purposes. Ownership and the legal status of AI-generated content vary by jurisdiction and may be uncertain; we make no representation that any Output is protectable by copyright or other intellectual property rights, or that it is free of third-party rights.
Outputs may be inaccurate or not unique. Outputs are generated by AI and may be inaccurate, unexpected, incomplete, or offensive, and may not reflect real people, places, or events. Because the model can generate similar results for different users, Outputs may not be unique, and similar or identical Outputs may be generated for others. You are responsible for evaluating Outputs before relying on or publishing them.
Your responsibility for use and disclosure. You are solely responsible for how you use Outputs and Creations, for ensuring you have the rights and consents required (see Section 5), and for complying with any law that requires you to label, watermark, or disclose that content is AI-generated or synthetic media.
The Services — including the LiveGen website(s), apps, software, user interface, the integration and orchestration of the underlying X2.0 model, the six modes, design, text, graphics, logos, and the "LiveGen" name and marks — are owned by LiveGen or its licensors (including Xmax with respect to its model and technology) and are protected by intellectual property and other laws.
Except for the limited license to use the Services granted in Section 4, we grant you no rights in or to the Services, our software, model access, or trademarks. You may not use our names, logos, or trademarks without our prior written permission. All rights not expressly granted are reserved.
Feedback you choose to give us about the Services is voluntary, and you grant us a perpetual, irrevocable, royalty-free license to use it without obligation to you.
We respect intellectual property rights and expect our users to do the same. If you believe content on the Services infringes your copyright or other intellectual property rights, please send a notice to legal@livegen.ai that includes:
Counter-notice. If your content was removed and you believe this was a mistake or misidentification, you may submit a counter-notice to legal@livegen.ai with the corresponding information required by applicable law.
Repeat infringers. We will, in appropriate circumstances, disable or terminate the Accounts of users who are repeat infringers.
Credits and metered generation. Generation on LiveGen is metered in credits, where 1 credit = 1 second of generation. When you run a mode, credits are consumed based on the number of seconds generated. Credits have no cash value, are not property, and are not refundable or transferable except as required by law or as expressly stated.
Free credits and free tier. New users receive free credits, and we offer a free tier. Free-tier exports include a LiveGen watermark, and some features, resolutions, or limits may differ from paid tiers. You may not misuse free credits or the free tier (for example, by creating multiple Accounts to obtain more free credits).
Paid plans and pricing. We offer paid subscription tiers and/or credit purchases. The prices, credit amounts, billing periods, and plan features are those shown at checkout or on our pricing page at the time of purchase. By purchasing, you authorize us and our payment processor to charge your selected payment method for the applicable amounts, plus any taxes.
Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price shown for your plan, and your payment method is charged, until you cancel.
Cancellation. You may cancel your subscription at any time through your Account settings or as otherwise described at checkout. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then, and you will not be charged for the next period. Except where required by law or expressly stated, we do not provide prorated refunds for partial periods.
Price changes. We may change prices, plans, credit amounts, or features. We will give you reasonable advance notice of changes that affect a subscription you hold, and changes will apply from your next billing period. If you do not agree to a price change, you may cancel before it takes effect.
Refunds. Except as required by applicable consumer-protection law or as expressly stated at purchase, fees and credit purchases are non-refundable. If you are a consumer entitled to a statutory withdrawal or "cooling-off" right, that right still applies; otherwise, amounts already used to generate content or to access paid features are non-refundable.
Taxes. Prices may exclude applicable taxes, levies, or duties. You are responsible for any such taxes, and we may collect them where required.
Payment processing. Payments are handled by a third-party payment processor; we do not store your full payment card details. Your use of payment features is also subject to the processor's terms, and our handling of related data is described in the Privacy Policy.
By you. You may stop using the Services and close your Account at any time through your Account settings or by contacting support@livegen.ai.
By us. We may suspend, restrict, or terminate your access to all or part of the Services, with or without notice, if we reasonably believe that:
Where practicable and lawful, we will give notice and, for less serious issues, an opportunity to cure.
Effect of termination. On termination, your license to use the Services ends, and we may delete or disable access to your Account and content, subject to the retention rules in the Privacy Policy and any legal obligations. Sections that by their nature should survive — including Section 6 (license grants and representations), Section 7, Section 9 (amounts owed), and Sections 11 through 15 — survive termination. Termination does not entitle you to a refund except as required by law or as expressly stated.
Please read this section carefully; it limits our responsibility.
To the maximum extent permitted by law, the Services, including all Inputs, Outputs, Creations, and the six modes, are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that:
The Services rely on third parties, including Xmax (which processes the streamed video to generate Output) and Cloudflare (which stores reference files); we are not responsible for those third parties' independent acts or omissions except as required by law.
Consumer-rights carve-out. Nothing in these Terms excludes or limits any warranty, guarantee, or right that cannot be excluded or limited under the mandatory consumer-protection laws that apply to you. Where such laws apply, the disclaimers above apply only to the extent permitted.
To the maximum extent permitted by law:
Non-excludable carve-out. Some jurisdictions do not allow certain exclusions or limitations of liability. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — such as liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer-protection laws. In those cases, our liability is limited to the least extent permitted by law.
To the extent permitted by law, you agree to indemnify, defend, and hold harmless LiveGen and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
We may, at our option, assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense. This section does not apply to the extent a claim arises from our own breach, or where such indemnity is not permitted by applicable consumer law.
Governing law. These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, except where mandatory local law (including consumer-protection law) provides otherwise.
Dispute resolution. The parties will first try to resolve any dispute informally by contacting legal@livegen.ai. If a dispute is not resolved informally within 30 days, it will be brought exclusively in the state or federal courts located in Delaware, and you and LiveGen consent to those courts' personal jurisdiction and venue. These Terms do not require binding arbitration and do not include a class-action or jury-trial waiver. Nothing in this section overrides any mandatory right you may have, as a consumer, to bring a claim in the courts of — or under the law of — your country or state of residence.
Venue. Subject to the mechanism confirmed above and to any mandatory consumer rights, the courts identified under the laws of the State of Delaware, USA will have jurisdiction over disputes not otherwise resolved.
Entire agreement. These Terms, together with the Privacy Policy and any additional terms that apply to specific features or plans, are the entire agreement between you and LiveGen regarding the Services and supersede any prior agreements on that subject.
Cross-reference to the Privacy Policy. Our Privacy Policy describes how we collect, use, share, and protect your data, including your live camera feed and facial/biometric data, and is incorporated into these Terms. Please read both documents together.
Assignment. You may not assign or transfer these Terms or your Account without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets, on notice to you.
Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of nature, outages, network or third-party (including Xmax or Cloudflare) failures, or governmental actions.
Survival. Provisions that by their nature should survive termination will survive, as described in Section 10.
No third-party beneficiaries. Except as expressly stated, these Terms do not create any third-party beneficiary rights.
